1. About these terms

These terms govern your use of movewelltraining.com and your purchase of any products from MOVEWELL Persona Training, ABN44648737657. By placing an order or using this site, you agree to these terms.

2. Health and fitness disclaimer

This is important, so please read it carefully.

Our training programs, nutrition guides and any other content we provide are for general information and educational purposes only. They are not medical advice, and we are not providing a medical, dietetic or allied health service.

You should consult a qualified medical practitioner before starting any new exercise or nutrition program, particularly if you are pregnant, have an existing injury or medical condition, are taking medication, or have any concerns about your health.

Exercise carries an inherent risk of injury. You participate at your own risk and are responsible for exercising within your own limits and stopping if you experience pain, dizziness or discomfort. To the extent permitted by law, MOVEWELL is not liable for any injury, loss or damage arising from your use of our programs. Nothing in this clause excludes any guarantee, right or remedy you have under the Australian Consumer Law.

Individual results vary. We make no guarantee of any specific fitness, performance or body-composition outcome.

3. Orders and pricing

All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable. We reserve the right to correct pricing errors and to refuse or cancel any order, including where a product has been listed at an incorrect price. If we cancel an order you have already paid for, we will refund you in full.

4. Digital products and licence

When you buy a digital program, you receive a personal, non-transferable licence to use it for your own individual training. You may not resell, share, redistribute, reproduce or publish any part of a program, or use it to train paying clients, without our written permission. All content remains our intellectual property.

5. Physical products

We do our best to display product colours accurately, but screens vary and we cannot guarantee that what you see exactly matches the physical item. Stock availability is not guaranteed until your order is confirmed.

6. Intellectual property

All content on this site — including text, program material, images, video, logos and branding — is owned by or licensed to MOVEWELL and is protected by copyright. You may not use it commercially without our written permission.

7. Accounts and acceptable use

If you create an account, you are responsible for keeping your login details secure and for any activity under your account. You agree not to use this site for any unlawful purpose, to attempt to gain unauthorised access to it, or to interfere with its operation.

8. Third-party links

Our site may link to third-party sites or services. We are not responsible for their content, products or privacy practices.

9. Limitation of liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, our liability to you for any claim relating to a product is limited to resupplying the product or refunding the price you paid for it.

10. Changes to these terms

We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.

11. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
